i'm 16, and an almost 20 year old fingered me, even tho i tried to resist. is that statuatory rape, even tho we didn't have sex? and because i didn't say no? he might have thought that i was playin hard to get.
so is it nothing, or is it statuatory rape, or sexual assault/battery.
and what's the difference between assault and rape?

RAPE is forced sexual intercourse, including both psychological coercion and physical force. Forced sexual intercourse means vaginal, anal or oral penetration by the offender(s). Sexual assaults may or may not involve force and include such things as grabbing or fondling. Sexual assault also includes verbal threats.

it was unwanted sexual contact and you should tell someone. you tried to resist and that's the same as saying no.

Rape involves penetration regardless of what did the penetrating. Assault is threatening to do something, battery is actually doing what you threatened to do, sexual battery would be sexual contact without penetration. The laws on statutory rape differ from state to state. Call your local police department and ask to speak to someone about it.

Rape is an act of sexual intercourse carried out:

where the victim is unable to resist because of an intoxicating, narcotic, or anesthetic substance that the accused has responsibility for administering.
where the victim is unconscious of the nature of the act and the perpetrator knows it.
where the victim believes, due to the perpetrator's intentional deceptive acts, that the perpetrator is her spouse.
where the perpetrator threatens to retaliate against the victim or any other person, and there is a reasonable possibility the perpetrator will execute the threat -- "threatens to retaliate" means threatens to kidnap, imprison, inflict extreme pain, serious bodily injury, or death.
where the victim is incapable of giving consent, and the perpetrator reasonably should know this.
where the perpetrator threatens to use public authority to imprison, arrest, or deport the victim or another, and the victim reasonably believes the perpetrator is a public official.

any sexual act that is against your will are consider rape. that's what the law says.

Fingering falls into gross sexual imposition category.

Rape would be more serious crime.
