Depending on the nature of his handicap, he may or may not be held accountable for his actions.
Rape by force is against the law. So is consensual sex if the person in question is under the state's minimum consent age. If both parties are under minimum age, then they've both committed a crime.
Whether or not this case ever goes to a juvenile court, that's up in the air and tons of things could influence it either way.

This is hard but she should not have been doing that with a 15 year old and she does need her mom and her mom's boyfriend to be in some sort of center.she also can't say that he raped her because he is autistic and she knew what she was doing.

What a terrible mess! Whether the 12-yr old girl is "developed" or not is irrelevant. She is a child. PERIOD. Your nephew has done very wrong. It should be understood that it´s not the girl´s fault. Both of the children need immediate help.

if her case worker expects her to be pregnant soon she should get her on birthcontrol, although thats sounds like an odd thing for a case worker to say w/o acting on it. obviously the girl needs counseling and love. as for the boy, mental prob is no excuse for what he did, he either knew it was wrong, in which case he should be punished. or he didnt, in which case he should NEVER again be left alone with a child.

Let the law sort it out. What an ugly mess. Don't blame the 11 year old. She is still a baby no matter what she's been through. She has been horribly abused and your nephew made it even worse.
