Can he/she be sued for discrimination since it isn't against the law for a pregnant women to drink?

I'm not pregant... It's just something I wonder about... judging you can sue McDonalds for their hot coffee or Marlboro for providing a product that gave you lung cancer.

Excellent question. I think the bartender should definitely refuse service, but from a legal standpoint, tough to say. The problem is, if he didn't refuse service, the lady had the baby, and it was deformed, she could possibly sue the bartender for negligence. Messed up world.

A bartender has the right to refuse service to anyone at any time, and there isn't anything that you can do about it if you are refused (unless you're being refused because of being underage, in which case showing a valid photographic ID can help).

Although if you do get refused at the bar, what's to stop you from going to a different bar? Why waste time with the thought of taking the issue to court when there are plenty other bars around?

I would think not, if it's indeed against the law for a pregnant woman to drink, What state/country are you from? Here in California, it's not illegal for a woman to drink if she's pregnant. Whether she should or not is another question, altogether.

And most places of business have posted signs that say something to the effect of: We retain the right to refuse service to anyone for any reason.

According to doctors, it is OK for a pregnant woman to have a glass or two of red wine. Now I'm not sure how much has been proven safe and I don't think it's a good idea but I'm not pregnant. I'm just a bartender answering this question.

Yes, a bartender can refuse service to anyone that under his/her best knowledge is not physically able to consume alcohol for the sake of responsible service of alcohol. If you call it discrimination against women, what about serving alcohol to children? Do you call it discrimination against children as well?

A bartender can refuse service to anybody. Many reasons for refusal are subjective ; as in "in the opinion of the server "

The bartender reserves the right to refuse service to anyone they choose. He doesn't have to serve anyone if he didn't want to. You can sue them but you will waist your money because you will lose.

yes they should why would a pregnant woman be in a bar anyway she should be thrown out on her *** but if i was bartender i would have to serve her but i wouldn't want to i would probably act like i'm putting some liquor in the glass

I don't know know if it'a grounds for a winning lawsuit or not, but I wouldn't do it. I'd quit first. Sue me. No jury would award that woman anything.
