Can I get out of this possession charge?

I was arrested for possession a week and a half ago, and today I found the roach I was arrest for in my car (that was all they found.) Can I get out of this charge since they have no evidence or am I still screwed?

i dont know about us laws- but in uk- the "evidence" would be seized and analyzed.. and then somewhere along the way the police have to have proof it was destroyed in the appropriate way...have u been charged with driving under the influence of an illegal substance? . in the county i live- we have a fairly new police unit , that specialises in drug driving.and does roadside testing.-i guess if a person was found to be under the influene of an illegal sustance-but didnt actually possess any..... they would still be charged with drugdriving-not possesion.....

if i was you id ask to know how much you are being charged with having? of what exactly? who were the arresting officers? etc.... a conviction for a drug offence is the last thing you need... in uk -the police can stop and search...if they believe a crime maybe-or has been commited without a search warrant- but they do have to give you a search log of where u were, who searched u. and what was found- and what action if any was taken....

you can get out of it being that they left the evidence behind. the only glitch may be that the judge will still believe the cop over you if they chose to pursue it. the cop can also say that you appeared to be under the influence of something or that he smelled pot in the car in which case you may be charged with something different from possession. they may drop the poss charge and charge you with something else if you act in your own defense. if you can afford one, get a lawyer.
