It probably depends on where you live. But I can tell you that in April my 50 yr old brother threatened my daughter's 28 yr old looser boyfriend and my brother did receive a visit from the police. They didn't arrest him but they could have. I think it probably depends on whether or not the cops think you're serious about the threat. The cops in this case realized my brother was just spouting off because the 27 yr old looser boyfriend is a total *** and brings out the worst in everyone he meets.

State laws vary. In California, three conditions must be met for a terrorist threat charge. The threat must be immediate, the threat must be unconditional and the threat must be something that the suspect could actually carry out.
So if I said "One of these days I'm going to get you." that wouldn't satisfy the first requirement.
If I said "I'll smack your face if you don't get away from me" the second requirement isn't met.
If I said "I'm coming over there to shove a nuke up your butt" the third requirement wouldn't be met.
Those requirements are for arrest for that charge only. There are other stalking laws and such that further define criminal acts of putting someone in fear for their safety.

Yes, you may be arrest for this. Generally it is referred to as Threaten and Intimidate. A similar charge might be harrassment or stalking.

The definition of 'assault' is to verbally threaten someone. 'Battery' is when you actually cause physical harm.
