I want to work in USA for a while...but i can't find a job since last year. So i have an idea to take a tourist visa and then change it...maybe to go to some school and get the visa J1 or to find some job and get the visa H1B. But i know in embassy will ask me - if i have any plans to stay in USA...And if i really do, and will not tell them and then will stay there for real - can they put me in jail for that or cick me out from country when the tourist visa will finish? Coz if i said i don't want to stay there but i will - it's a double aims...Can they punish me for that? I don't want be there illegal - yr advise - guys

You can apply to school and get an F-1 visa. this gives you OPT /EAD card which allows you to work legally in the U.S. and have time to find an H-1B sponsor. You can get a J-1 only if your job is one of the prequalified jobs. You can only do a change of status if you have a J-1, F-1, L-1 or other qualified work visas. There are many people here on work visas (nonimmigrant) that have also applied for green cards. As long as you are in the country legally and eventually apply for your green card that's fine. If you are here illegally an marry a U.S.Citizen you still have a shot. If you apply for a work visa and they ask you your intent you say to work. Trust me no immigration officer is shocked to know you want to stay forever.

P.S. No need to get nasty people. With the exception of American Indians we all come from, or are immigrants from another country.

I was born in this country and am having trouble finding a job. Join the crowd. Don't like it? Leave. Apparently, all you people do is come here and complain about how badly Americans treat you anyway so why don't you just leave?

It is illegal if you don't get a change of status approved before your tourist visa runs out and it is very unlikely you will get that in that time frame. So, yes, that would be illegal.

Are you already here? If you are you could get punished bc you're illegal. Get you're papers and become legal! It's not that hard to figure out. Don't even think about coming over here if you aren't going to be a legal immigrant

I am glad that you don't want to come to this country illegally. If you don't go home when you are supposed to, they will kick you out.
