Depends on the state, it is definitely a misdemeanor and possibly a felony.

And, if there are child custody issues, will most likely result in her losing custody (assuming she had custody) and restricted visitation.

In the state of Oregon, domestic violence is a felony. I know this to be true because when my granddaughter was taken by her father (kidnapped actually) my whole family (Grandpa, Gramma & daughter) went to get her back and my daughter was hitting her while the child was in the arms of the psycho stepmom. Yeah, it started out being a felony but the court decided to drop it to misdemenors. Got time served and $200 fine (a piece) and community service. I hope things work out well for you too.

It can go either way, also domestic violence conviction can restrict a person from ever owning a gun in the future and also stop them from getting some jobs ( no matter what level it is)

They need an attorney and try to work a plea or something out.

Depends on where you live as far as I know. In the state of Oklahoma, Domestic Assault in the Presence of a Minor Child is a felony......oooops.

If it was a Misdemenor she probaly would'nt have gotten arrested, but have only gotten a ticket.

no, this is called aggrevated assault. and if she had a weapon in her hands it's aggrevated assault with the intention to do bodily harm with a weapon. Could be detained for a felony assault charge.
