I am being harrassed for child support for a child I do not have. They want to garnish wages, income tax withholdings, property leins and even maybe criminal charges.There is no proof of paternity. I never signed any birth certificate or ever even been to court. I do not even know the custodial person. I have already sent a mistaken identity form, certified mail, return receipt requested. Each month the arrears accrue interest. I'm at $10,000 now. I have been reported to the IRS and the FTB. Anyone know anything about this? HELP!!!

Anyone can sue anyone else over anything. Would you prevail? Probably not. You don't have to sign a birth certificate or appear in court. If the mother said you were the father, then you probably should see an attorney about taking a paternity test. Then they will know for sure. If you aren't, you can get your life back on track. Of course if you are, be prepared to pay out over $10,000. Good luck with it.

You sue the state to take care of their DA. That is if you have a good trial lawyer that would take the rap for you.

the only way to solve this is by taking a DNA test to prove that this child is not yours,once done the state will in turn will have to refund your money.then sue them.
