In the US, if you are underage--even if you "want it"--it is considered rape if an older person makes love to you. For example, let's say you are 15. If your partner is 18 or over 18 and he/she makes love to you--even if you both wanted to do it--he/she could go be charged with statutory rape because you are a minor and he (or she) is not.

A friend of mine in Texas was 18 or 19 when he got a 15-year-old pregnant. They were dating when she got pregnant. And her parents loved him...up until the time she got pregnant. They took him to court; to make a long story short, the judge ruled in this manner: He gave my friend a choice: either go to prison for the statutory rape, or marry the girl. My friend decided to marry the girl, but the marriage didn't last long. They couldn't get along; he wasn't happy living with the girl's parents; the parents didn't like him anymore; he couldn't get a good job to support the girl or the baby...etc., etc., so they wound up separating. I lost contact with him, so I don't know what happened to the baby. I'm sure the girl and/or her parents decided to raise it.

This is a perfectly legitimate question, so whoever said this is a stupid question, try to be more open. Obviously if you are a minor, there are many things you want to know before you do them; we should try to help rather than blow these questions off. It could be your child asking you this question some day.

So the bottom line is, if you are underage and you are thinking of having sex with your adult partner, don't do it. Wait until you are at least 18. Even if you and your partner are both 14 or 15 or 16 or 17, or any age below 18--wait until you guys are at least 18. You don't want to wind up being 15 with a baby living with your parents.

If you want it, then you are consenting to the act, I presume, in which case, it is not rape. Rape is when the act is done with out the consent of the victim. Also, it is rape if an adult (over age 18) has sex with a minor (under age 18). Minors cannot reason things out properly yet (based on scientific study) and are easily taken advantage of. Minors have yet to realize the difference between sex and love, so even with the minor's consent, it is considered rape due to the minor's inability to make an intelligent decision.

It depends. If you are under 18 (16 at minimum in many states) you are considered below "the age of reason" and even if you do "want it" the court will say that weren't old enough to make a logical decision about it. Same goes for if you're drunk. You might want it then and regret it the next day, in which case it would be considered rape because the "rapist" would be taking advantage of the alcohol in the other's system.

If you say yes, the only way it could be rape is statchitory (sp?)...as in you are too young to make up your own mind and the government or your parents can press charges without your permission. However, if you EVER say no-then it can be rape, so be careful if you are simply role-playing with your lover....

Rape is when a person is forced to have sex. If one person is a minor,and the other is 18 or older,then it's Statutory Rape,regardless if you wanted it or not.

If you say No and mean it, then yes they are raping you. If your under 16, then yes they are raping you legally. However, if you're faking around and just want to say "hey he raped me!!!!!" and you don't say No or you say No and don't get the message across, then you really are consenting.

I'd say any sex act can be considered rape if consent is not explictly given . . .

. . . at least, any person engaging in a sexual act better believe that's what rape is, so they can make sure to be responsible and forthright.

In my opinion the willing can't be raped...but it depends on the age if you want to go into legalities

If you are a minor and your partner is an adult. It is statutory rape. A minor cannot under any condition give license to adult behavior.

If you want it and are an adult it is then consensual. If you are a child or say NO it is rape.
