what will be the status of a dependent child below 21 yrs old whose mother has a pending labor certification?

the child is here in US before the mother got the labor certification and the priority number is oct 18 ,2002. the child is now 22 yrs old

It will depend on what type of visa. If it's an H1, the child's age at the time of visa application counts; if it's an E immigrant visa, then the age at the date of the petition filing rules.
