Seven years ago my brother married a woman from Greece. Her parents didn't approve that marriage and they stopped every contact with her. My brother and his wife were crazy about each other, so they got married after all. A few months ago they died in a car accident. Their daughter is 6 years old and suddenly her mother's family from Greece wants to take her away. Can they do that?

It will depend on the courts. They can't take her without going through the legalities. I'm curious though... does she even know them? I mean if her mother had nothing to do with her parents then does the little girl even know her grandparents. I would think that would be very traumatic for her to leave familiar surroundings on top of losing her parents. It would be interesting to see the court systems ruling. I'll certainly pray for the little girls best interests to be remembered!

yes they can because grandparents have specific rights. Especially if both biological parents are deceased. If the fathers parents are living they can contest. PLEEEEEEEEEESe remember that the little girl has already been emotionally devastated by the lost of both her parents hopefully you as the child's aunt or uncle will remain supportive no matter what the out come is If everyone can come to a good common ground it would be beneficial to that poor little girl. First of all, sorry for your loss.

Now with regard to the custody:

Did your brother and his wife have a will? Does this will say who should get their child in the event that they died?

Perhaps the little girl can be with you since you have been "closer" to the family and the child knows you more.

It is possible that the wife's mother's family can take the child...

If you want the child to stay with you in the states, then fight for her.

oh how awful. Did they leave anyone as the guardian? If so in paperwork, who ever they left the child to, would have legal guardianship over them, other than that, I would say next of kin. Which could be you, or whoever has custody of her at this moment. who she's living with since the accident. I would get a lawyer, and talk this over with them.

They will have to go to court. And it depends on who has her nowif they want her or do they want to spend the money to fight it out in court.

in the us they would have grandparents rights but I'm not sure how that would work in this case call a lawyer
