When I got my traffic ticket in the mail the other day, my name was badly misspelled, to the point where it was hardly recognizable as my name. The address was mispelled also. Does that get me off the hook?

Probably not... the officer or prosecuting attorney can always move to amend the ticket to reflect the correct name spelling. The only thing that it could help you on in fighting the ticket is that, if the spelling is completely incorrect, it could be used to show that the officer is not a careful officer (impeaching him if he states he is always careful about his actions on the job). Check on your state's law though... there could always be caselaw that says if the officer messed up in that way, you have an out (but I doubt it).

Nope - if the ticket found you by mail (although there were misspellings), you're on the hook. Also your license number and VIN number are on the ticket so, even if it took the police department awhile to find you, the DMV would help them out. Grin it and bear it and go to traffic school to keep it off your record. You can take traffic school on-line, or a comedy traffic school, traffic school with pizza, etc. See what appeals to you.

It might help. If you show the judge your license and the ticket, and if the car you were driving in is registered to someone else, you may be able to prove that you were not the person who got the ticket, but that you felt compelled to stand up for the owner of the car.

The point is that the judge won't be able to distinguish from you or the owner of the car. Unless the car is licensed to you, then it may be a mitigating factor.

You also didn't say, but did the ticket have your license number or your car's license number on it? That might help.

Probably not. Usually they put your DL number on the ticket as well. That is how it is traced. Well, that and the license plate number. As long as they have those correct, I would pay up.

I did...but I hired a traffic attorney to help me, make sure to find out if he plays golf with the judge first.
