No! An undercover cop does NOT have to tell you he or she is a cop. That is an urban legend passed around in a lot of movies. Entrapment is when a cop, undercover or whatever, ENTICES someone to do something they normally would not do, and normally would not have done had they not been enticed. Example, if I walk directly up to a beautiful girl on the sidewalk and ask her to sleep with me for $50 bucks, it isn't entrapment, even if she lies about being a cop. The entrapment defense would be even less likely to work if we were in an area where hookers are not generally known to frequent. If I was walking down a street known for such things, and the girl was dressed real sexy, the entrapment defense still wouldn't likely succeed, because I could have just kept going. Clearly, a jury or judge would assume I was trolling for hookers if I was hanging out in such an area. However, if the undercover female cop initiates a conversation with me first, and offers sex for money, then it is entrapment, because it could be argued that if she hadn't enticed me, I would have just kept walking, Especially if she talks all sexy, is wearing provocative clothes, and touches me in a way that would get a normal guy aroused, then entrapment becomes an increasingly likely defense. The line is not always clear. Ultimately, it is up to the courts to determine if the officer's conduct was reasonable or if it went so far as to entice someone to commit a crime. In the movie you saw, PeeWee was clearly the instigator of the transaction, and crying entrapment wouldn't have worked. El Chistoso

You cannot tell. Watch the movie Donnie Brasco, about an underccover cop that infiltrated the mafia, and the mobster who asked him to join was later killed by the other mobsters, which was unfair because they all were fooled. There are lots of myths that cops can't take off their clothes (hookers think that), but recently there were two police departments in different parts of the country (Virginia and Kentucky, I think) where the undercover cops busted some hookers by getting undressed AND having sex with the hookers and then arresting them! There is nothing an undercover cop will not do to keep from blowing his cover. An undercover cop WILL commit crimes if even slightly necessary to stay undercover. Eventually, we will see cases where undercover cops have killed bad guys on the street, and they will get away with it by saying that they needed to do so to maintain their cover, and they only killed a bad guy anyway. Personally, I have no doubt that a cop will eventually do this and be acquitted of murder. (Though this is not to say that in some cases the cop would not be convicted.) However, you will know sometimes, like somebody else said, once you are busted and you see your former "friend" on TV bragging about how he took you down, and you never knew he was a cop. Then you can sit in your cell for the next 20 years, going over all the details that should have tipped you off. And, you might even be lucky enough to have a cell mate who has similar stories, and you can compare notes on how to detect an undercover cop. Then after 20 years, or less if you behave, you can hit the bricks and try out your theories. Hope you can spot the next one! If not, your old cell is still there.

If you or anyone else can tell if he's an Undercover Cop, he's not doing a very good job.

You won't,
as a supervisor I have had undercover cops look at 18 year old kids working on a loading dock of a warehouse, i have had a 50 year old pot bellied man working at office, they took young looking correctional officers and used them for undercover drug people living in the projects.
If you can tell who they are, then most likely that is not them.

I just go up to 'em & ask if they're gettin' paid extra for workin' overtime! My specialty is helping out the poor darlings who have been victimized by a really bad costuming & prop department. I see them on the street attemping to be homeless with shopping carts, but there ain't nothin' in the cart & the dude just looks so out of place, cuz he's gotta pee & he can't leave his post, so I give 'em coffee candy to keep it real! I always ask them "who did you piss off to end up here?" It's a wonderful life & everybody needs a job. More importantly, they get real life on-the-job training!!! You should be happy you can see what others don't.

Ask them where they went to high school, then compare the results with records from your local police academies. Or follow up with MYSPACE and talk to friends of the person see if they drop any hingts on whether their frind was interested in being a cop or actually became one. Just remember exposing an under cover cop is a crime, even if that racket breaker is a sleazy no good bottom feeder.
