I know you think you are being funny and perhaps to you and your "same level" peers, you are...but rape is not funny at all. As for what the crime would be, rape is rape and it's not a sexual act or sexual crime, it is a violent crime. Sex has very little to do with the reason the act is committed. So, if a person just wanted to have sex, they'd hire the prostitute, if they wanted to demonstrate power and anger, they would rape the prostitute.

Is asking a question like this an innocent act or just stupidity?

That depends. If a person were to actually "Rape" a prostitute it would be Rape but, in my state if a person has "Sex" with a prostitue and does not pay she can charge him with Rape (even though its really "Theft of services").

Rape, as the fact that he or she is a person is more important than the fact that he or she is a prostitute.

Carnal knowledge of a person, male or female, against their wishes is rape. It matters not if they're a prostitute, it is still their body.

rape if it is by force; shoplifting is she perform her part and you don't pay her. It is also shoplifting against her pimp since the prostitutes are the pimps merchandise.

Rape is rape. And any legitimate police department will go after a prostitute rapist just as much as any other rapist.
