We have been married almost a year. We can not afford sending him to mexico for a year as some say he needs to do to get legalized. We will lose our home and vehicles because I would not be able to pay the bills without his income. He wants to do things the legal way. He has been caught by the immagration so he is on record but thats about it. His record is clean and he pays his taxes.

He will have to go back since he entered illegally but since he has been caught by immigration he may have to stay there for up to 10 years because there is a 10 year bar rule but you really may want to consider getting an attorney if you guys are serious about trying to fix his papers. But all illegal immigrants have to return to their country in order to fix papers if they entered illegally.

You should start by sending in your paperwork to the immigration authorities ... he will in all likelihood get a temporary green card ... the fact that he came here illegally though, and got caught, means he will be on record as a law breaker, and that could go against your application ...

Didn't you think of that before you married him ?? My daughter did the same thing . She even went back to Mexico with him for a while . She owned her own home and after they were married he wanted his name on the papers .Thank GOD we talked her out of that . After 3 months and $800 in phone calls to Mexico , his mother , father and 3 brothers came to live with them and then came 4 other relatives to live in a 3 bedroom home , Mother took over the house and cooking , They had family meetings . My daughter was not included. They only spoke Spanish . they went out together while she worked , so she couldn't go with them . Her husband told they had no money ,it was sent back to Mexico for when they all went home , not her. She was married 8 months before she kicked them all out and then had to go bankruptcy and divorced him and his family . She was in debt over $ 14,000 , by the time she was done with him .
She was not the only one . It has happened to many, many woman who get involved with illegals. It's sad but true . They only want a place to stay while they are here to save money and go home and live rich .

Please don't compare the little sales taxes he pays to the income taxes, property taxes, school taxes and other taxes LEGAL citizens pay.

He needs to go through the legal process like my grandparents did. It was not easy for them, but they lived through it.

And yes, if he wants to live here and reap the benefits, he should learn English.

It would be nice to register under any work scheme like the one being proposed by George Bush, offering illegal aliens the right to work under temporary work visas in exchange for making themselves available to INS for proper documentation.

As soon he becomes a documented illegal alien, you would have a strong battle ground to fight INS and grant your husband a greencard on the basis of marriage. Hope you find this info useful.

He should of done that before he came here. And as far as you are concerned if you wanted to be in the US you should not of married an illegal. So i say tough sh!t. And as far as taxes are concerned that is BS. I have seen check stubs form illegals and they are not paying taxes.

Sorry for your predicament, but you brought it onto yourself. Perhaps you should have gotten him legalized before you were dependent on him and his income?
