I have a friend who was seeing this female and she got pregnant and is saying that he is the father but heres the problem she was with two other guys before she was with my friend she gave birth to the baby and says whe gave the baby my friends last name so i was wondering if it is legal to give the child the last name without knowing if hes the father and if he didnt sign the birth certificate

YOU CAN GIVE A CHILD ANY LAST NAME YOU WOULD LIKE THE CHILD COULD HAVE THE LAST NAME BATMAN IF YOU WOULD LIKE, THE GUY IS NOT LEGALLY RESPONSIBLE FOR THE CHILD THOUGH, UNLESS HE LATER ON ADOPTS THE CHILD OR REALLY IS THE FATHER IN WHICH A BLOOD TEST WILL BE USED TO PROVE IT

Well if they lived in texas they would have done a dna test when the child was born. I would get a test done if the "father" doesnt like his name being used. Cause the test will also prove that if he is the father they will make him start paying child support. I for one would get it figured out while the child is small because how do you explain it to a child that you have a diffrent last name than they do especailly if the child isnt his. I would get a test and see what happens and go from there.

You can name anybody anything. If he didn't sign the birth cert then I doubt he is listed as the father(assuming he didn't marry her). Tell your buddy to do what my nephew did. Get a lawyer and court order a paternity test(may cost some$). Then, if the baby isn't his he can sue to have the birth certificate changed(you may be able to do this before the pat. test). However, if it turns out to be his he will probably have to start paying child support, then he has to sue for visitation. Tell your buddy good luck. Make sure he a gets a lawyer-its not as expensive as it sounds.

You can name a baby anything you want.

As far as the birth certificate he might be able to keep his name off of it as the father legally.

She give the baby any name she wants, that is totally legal. It can be the name of a superstar, but when she trys to get child support that when your friend should get dna testing and seek legal advise if needed.

it isn't legal to give a baby the name of some random guy not to mention that it is just plain stupid. what is she going to do when he calls for a DNA test and he isn't the father and he wants his name removed what will she tell her child when the child grows up and has no last name. living with only one name only works for the rich and famous and i gather that she is neither

Sure it's legal. Did she ask your friend first though? Is he going to raise this baby as his own? Or adopt him/her anytime in the near future? If he's really concerned about this situation why not get a DNA test done so he knows for sure!

It is perfectly legal to name a child anything. What you are talking about legal resposibility, and to protest that takes a DNA test and court.

If she did it, it must be ok. She needs to think about when the child grows up and starts asking questions about his dad and it will happen.
Be careful she hasn't gotten into something she can't get out of.
