and they have no insurance is it my fault , i was turning into a narrow parking lot with almost no elbow room i was cut off by another guy rushing to get the spot where its a no parking area yet he still parked there causing me to hit the car next to me only thing is she had no insurance and in texas u at least need general liability or u get ur car towed away . i wasnt sure if she was wrong for driving without insurance and accidently got hit and oh well but i didnt want her to get her car impounded what do u think about this ?

she left the scene rior to me calling the police she said she was scared i stayed for the police she wasnt going to give me any info on her whereabouts so i took the license plate and reported the situation

The principle of law is that you take your victim as you find them ... you committed the legal wrong therefore you pay. Yes she was wrong for not having insurance but it isn't relevant to you.

You aren't responsible for additional reparation if they get lifted by the police for not having insurance.

I think if you didnt call the police and report the accident there isnt a whole lot you can do. Insurance companies will need to verify who was at fault, and the circumstances of the accident to know who to charge, pay, and penalize. They do that by police and witness records.

If you did report it, you can just not tell your insurance about it and pay from your own pocket for the damages. Really the only way to get you out of the hole is to have reported the behavior of the person who cut you off. Generally if YOU hit a parked car, they will assume YOU are at fault, unless theres documented evidence otherwise.

If the parking lot is on private property, you will more than likely be responsible for your own repairs. If the other vehicle was legally parked, you will more than likely be responsible for her too. You could attempt to recover money from the party that cut you off claiming that he caused you to hit the parked vehicle.
Leaving the scene of an accident is a big deal, and can get your license suspended in certain situations. Add on the operating without proof of insurance and she could be in real trouble.

you are a very irresponsible young man and if this was my car I would want to press charges on her because it is a selfish and ignorant question.
I guess if I was you I would be a scared kid and run away but if you get caught hitting and running, you will be in so so much trouble and you need to learn how to take responsibility for your actions. now is a good time. if you were not driving, you are not as fault but you were there and saw the whole thing. I am not sure how that works.
never drive with no insurance and never drive someone Else's car either. this is a good way to go to jail and ruin your life and end up in the jail with a big man who thinks you are a pretty little boy...think of this the next time you want to do something stupid, OK. PICK BETTER FRIENDS!
you know if you are with a person and riding in their car and they do something very bad...you are there and will go to jail too...
just being with someone who kills someone and not stopping it will give you also prison for killing someone.
If you are in the car and she had a joint or drugs were found in the car, or a knife, etc...you would get into trouble too.

The female does it again! You let her get away with it all.You started to think with the wrong head! If you had reported the accident, none of this would have been your fault. Did you at least get a name or number? Plate? Get a date? Anything that would help you here? If not, then you are at fault, unless you left the scene of an accident, which carries a heftier fine. Did you at least leave a note on the car that you hit?

So do you think that in the same situation you would not have hit her had she had insurance?? it was an accident you are still at fault your insurance should still cover her damage even though she is not insured

Yikes, that's a tough situation to be in. You know, I would probably let it go. You really don't owe her anything. She shouldn't have been driving in the first place. Can you imagine if she was the one to have hit someone? So, unless you caused more than simple aesthetic damage to her car, I wouldn't report it.

You are both wrong. You hit her, which sucks but it's the law that she has no insurance. You should talk to the police and/or DMV about the situation.
