If her father is US Citizen, she can get the US nationality and you, as well, regardless of where she born.
You got to follow the US Migration process, which is a file filling process.. And you both are done....

"I thought she had to be born in the US to be a citizen.......hmmm, guess I should brush up on my citizenship laws... " Good idea. You don't have to be born in the US to be a US citizen.

Military status has *nothing* to do with it and is not a requirement. The child will not have to go through immigration or migration processes. The child will automatically be a US citizen as long as all the requirements are met.

Folks, if you don't know the answer, don't make one up. I supplemented my personal knowledge with a 30 second search of information.

Your child will most likely have the right to claim either Mexican or American citizenship before she turns 18. You'll need to contact the US Embassy or Department of State to request a 'Consular Report of Birth Abroad' - and there are certain citizenship requirements that the father will have to prove. The report does not guarantee citizenship - it is an acknowledgment of the birth.

And, the two parents have to be married. If you are not married, there are more requirements (such as a paternity test and guarantee of financial support for the child).

Probably. You may want to consult someone in immigration instead of yahoo for an answer. I would choose one country to raise your baby, as if the mother ever chooses to bring the baby back to Mexico and leave you, you will have a hard time getting your child back or seeing your child again.
