Common assault is illegal under section 39 of the Criminal Justice Act 1988. Firstly I need to distinguish between assault and battery. An assault occurs when one person makes 'threats' (for example) to another, they beleive that they are in danger and/or are offended (particularly in relation to a common assault). A battery occurs when something undesired actually physically touches another by the control of someone else. Common assault and battery are the mildest forms of assault and battery and are prohibited to inhibit molestation and harrassment. Examples of common assault and battery include an undesired kiss, poking someone, even someone patting you on the back can be considered as a comon assault.

Is simply causing the apprehension of immediate harm. No physical contact is needed. Words can cancel an assault (Tuberville v Savage 1561 i think is the year). Silence can constitute an assault (R v Ireland)

It means that if a kid throws a brick at your window and it smashes and glass shatters all over your baby that if you go out and slap the kid round the head and drag him to his parents they will ring the police and get you charged with common assault also they may go to a lawyer and sue you for violation of human rights.

Causing another to apprehend unlawful physical violence. Doesn't have to amount to actual physical contact, but in most cases it does. However if someone is actually injured, then the offender will be charged with Actual Bodily Harm.
