It's been an hour and there are 7 wrong answers...
The k definitely belongs on top, which means that there is another reason why certain letters are on top, and certain ones are below.

It's in the beat, its a musical equation, which is why I still think the k belong below. :)

The first twenty-three letters of the alphabet are shown arranged either above or below a line, according to a certain pattern.


The upper letters enclose area (or have loops) and the lower ones do not. Thus X, Y, Z belong under the line. Mathematically this is stated, "the upper letters are homologically nontrivial."
