Having been side-swiped by a bus while riding as a passenger in a car in Shanghai, I can attest to the accuracy of Nikki's comments.

Our driver and the bus driver got into a fairly heated argument over "damages" while our host translated the exchange for our amusement. Initially, the bus driver was offering 300 yuan and our driver was demanding 2000.

Then the bus driver spotted the two "round eyes" in the back seat of our car -- myself and my colleague -- and the tables turned. Suddenly HE was the "injured" party and he demanded 5000 yuan from us!

This went back and fourth for the better part of an hour when they agreed that the bus driver would pay our driver 200 yuan and we would pay our driver 50 yuan each. (How they came up with this "deal" is beyond me as we weren't part of the negotiations.)

The whole time we sat in the middle of an 8-lane boulevard with vehicles whizzing by us on both sides. That was quite a bit scarier than the actual accident itself which was just a glancing blow.

The epilogue: Our driver got the car fixed for 300 yuan, about $37.00 or so. That would have been $1,500 - $2,000 in the US! So, being nice guys, we chipped in the 50 yuan each to cover his loss.

Hi,

Officially, all traffic accidents must be reported to the police. Exempt are cases where only minor damage was done to the vehicle, with nobody hurt, injured or killed. Cases of self-damage (e.g., driving into a tree) officially need to be reported to the police, but in reality, few people bother. This, however, indicates a waiver of responsibility for the insurance company.

When a collision occurs between two vehicles it is almost always resolved by the payment of money by one party to the other on the spot, with or without any admission of fault. After initial indignation or recalcitrance, one or both parties will demand financial compensation. It is supposed that either party considers the socio-economic status and occupation of the other, and the desirability of saving face. Eventually one party will relent, and they will bargain down to an agreeable amount of compensation.

Another feature of a traffic accident in China is that in all cases, neither party will move their vehicle from the position that it came to rest following the collision, regardless of its effect on the flow of traffic. It is a justifiable fear of many Chinese motorists not to move their vehicle from the scene of an accident because recent traffic law changes have provided for hefty penalties in the event of a hit-and-run. A driver found guilty of hit-and-run forfeits his or her license for life, and any party to an accident who flees the scene is subject to severe sanctions.

The chinese legal system is terrible and chinese people never think anything is their fault, but at the same time they love games of chance. Therefore, you should challenge this driver to one game of Bacharat or Pai Gow Poker or chinese checkers. Winner take all. It will be worth the risk. If you lose, hop in your car and drive away quickly. I promise he won't get your license plate number because chinese people have notoriously bad eyesight. Good luck!

Did you report it to your insurance company? I was once in a simlar type accident, here in California. She was clearly an insurance fraud. Stayed close to me, in the opposite lane on purpose. I tried to get a little ahead of her, and safely turn into the left lane-something I had done numerous times. She caught up, and got so close that our two cars hit. I told the insurance company about it. They refused to accept her claim, but they also called it my fault, even though it was hers. But they agent said, that he'd be the police on the matter, so to speak, between me and that driver. I'm no longer a customer of that company, but I think you get my point. Back to your case- I assume you speak Chinese? Tell him/her that he/she shouldn't be driving. That he/she caused your car a lot of damage- more than you can pay for alone. That the accident was his/her fault, that what he/she did was wrong, but you'll forgive if he/she pays for the damge, promptly.

Im not familiar with any of the driving regulations in China so I'm not able to help in any way.

But I did think it was amusing how your question read!!! It sounded like it was something you bought at a store! "Hey look! I got this cool accident and it was on sale"!!!
