My ? earlier did not cover entire burglary suspicion: can police arrest me for burglary of a building only because I parked my vehicle beside the bldg? I left the premises in another car with a friend and came back to find the police there (they watched me pull up in another vehicle) We told them we met up, parked my truck, and drove around town for 30 minutes and my friend was dropping me back off at my truck. My wallet/ID was inside my truck, they wouldn't let me get it. They saw boltcutters in the back of my truck that I use as an electrician and then accused me of breaking in to the bldg. There was also an 18 wheeler there that just started up and drove off right in front of the officers (it was there the whole time-why was MY truck subject to a search and not the 18 wheeler?) They arrested me for burglary and searched my truck while I was cuffed in car. They found about 5$ worth of meth inside console, under my wallet. Burglary chgs were never "dropped"-or ever mentioned again.

I used to be an electrician for almost 7 years and never used a set of bolt cutters. I worked commercial, industrial, and residential. So try some other excuse.

$5 worth of meth? Your other post said you got caught with "1/4 gram". Since when is a 1/4 gram of meth only $5??? That's more like $80-$120 worth of meth. You are so full of bull.


Here's my favorite quote from you:

First off, you tell us right here that "we told them." In other words, that's not what you actually did, it's just the story you told the cops.

Second, that's not even a believable story. Why would he pick you up there just to drive you around for 30 minutes, and then just return you to the location?

Most jurisdictions have laws regarding possession of burglar's tools. Bolt cutters clearly fit in this category as do many other common hand tools. Leaving these in plain sight is all of the probable cause that the cop needed.

Parking your car where you did gave rise to "reasonable suspicion". That's all the cop needed to approach you and question your activities. Since you had "burglar's tools" in plain sight, he now had probable cause for the search. Once he has probable cause anything else that he finds is fair game. Stupid you for riding around with meth in your truck!

Had the bolt cutters been locked away out of sight, the cop would not have had probable cause for a search. If he had searched your vehicle without your consent, the search probably would have been ruled illegal and any evidence found would have been thrown out.

He didn't have probable cause to search the semi because virtually nothing in the cab of a semi is in plain sight from the ground.

A really good attorney might be able to challenge the search. I suggest that you speak to one.

If there was just a burglary in the building that involved the use of bolt cutters, they probably had probable cause. If not, they probably didn't. Depends on outside circumstances.

And looking into your truck to see the bolt cutters is not an illegal search, even without probable cause.

Probable cause was found due to the bolt cutters being in the veichle. There is a statute of limitations for the burglary charges. Talk with your attorney as they may have made it into a plea bargin with your attorney.

it is a known fact that 99% of tweakers are theives. The bolt cutters were in plain view obviously the burlgary involved the use of bolt cutters......bolt cutters are burglary tools so next time try to come up with a better lie......... electricians dont use bolt cutters........

Tsk, tsk,..... shouldn't have had the meth. Consider yourself fortunate for being caught while you can still complete a semi literate sentence.

If you spend your energies "fighting" this bust, you'll undoubtedly live your life on the downhill slide.
