On May 1st, 2004, I was coming up on an intersection & was a car's length from the crosswalk. The light turned yellow & this guy made a left in front of me. I had no where to go & no time to stop safely. We colided & he is trying to say he was already committed in his turn when I hit him. An officer came out, wrote up the report & made it to where both of our stories were true & erased 1 lane. There were 5 lanes (3 straight, 1 right, 1left turn lanes). According to his witness' I made an illeagal lane change, drove thru 2 lanes of stopped traffic prior to hitting him, this is a lie. I was driving down the middle lane & saw him sitting in the intersection waiting to make his left. He says he's 100% innocent in this accident & that I'm the one at fault. At least no one got cited & all was well till my sister decided to sue one of us, (she was a passenger in my car). She wants to get that guy to admit being at fault & doesn't want to sue me, but I have to be involved. Can anyone help me?

If I read this correctly, you still had the right away and he needed to yeild to oncoming traffic no matter what! Commited in his turn? So... he is admitting to fault. He can only be commited in his turn and not be at fault if you went through a red light. Yellow is still yellow and I believe if your back tires are over the the farthest line of the cross-walk before the light turnes red you still have the right away. If you were only a car length away when it just turned yellow you still should have made the light. The witness does not make sense, but I don't know if I am painting the correct picture in my head.

Was your sister hurt in the accident? I find it silly that she wants to sue one of you. Plus, if your accident was in 2004 there are Stautes of Limitations. It may be up to three years that someone can still sue after an accident, so she might be within the time- frame still. You should be the one going after him first. Then she can follow, if you able to prove he is at fault. If she sues you that tells me she's sue happy to sue even her own sister! I wish the best for you and hopefully you will prove he is at fault!

call a shiester, you know the lawyers on day time tv, why is she suing??

get the police report it will tell you who is legally at fault!
