I just married about a month ago. My son's father has not been in contact or tried to see him in over 3 months. I know for a fact that he does not have any interest in or care for the child. Anyways, my new husband is really eager to adopt and I know he will love and provide for my son to no end. Does anyone know the steps or what i need to do to start the ball rolling on this? Please, any info helps tremendously!!!!!

The first thing you need to do is contact your local court system and look into the adoption specialist. They will give you pages and pages of paperwork to fill out, may require a home visit, a small fee, and your son's biological father will have to appear in court stating that he is willing to waive his parental rights. We had to be married six months before the process could begin in the courts, but we also had to get physicals and such, so start now! Best of luck to you. You can petition the court (generally thru a lawyer, but not always necessary) to force the birth father to give up his right to the child so he may be adopted by your husband. It's actually quite simple, unless the child's birth father fights you on it. The laws differ with each state, but it will most certainly need to go to court. It is, after all, a legal matter. Try Legal Aid in your area. Or, contact an attorney that deals in adoptions. A divorce attorney may even have some answers for you and consultations are sometimes free.

I know in Kansas, the biological father has to be absent with NO contact for a two year period. Then you can contact the courthouse and make arrangements to go before a judge. Most attorneys will discuss things like this over the phone, giving you a better idea of all the details involved. I think it's great that your new husband loves your son so much. However (although I'm sure you don't), please be careful not to promote bad feelings and negative comments about his biological father. I doubt that he will remain out of the picture indefinitely. When/If he does come back into your son's life, your son will see him for who he is and not have resentment toward you for influencing his opinion. Good luck to all of you!

I actually have a daughter, whom my husband and I adopted.First. HIRE a lawyer.Look for one who specializes in adoptions/family law.For us, (ours was a family member who couldn't keep the child)the lawyer did almost all the work.However, we still had to do a homestudy(where social services comes in and checks your home out/situation).Also, the lawyer will know more, but your child's biological father will have to sign away his parental rights.However, there is a way(IF he is a no find)to publish his name in the news to try and give him a chance to fight it.The best step is hire a lawyer.Since ours was relatively easy, and family, it only cost about $1300. for all the legal stuff.To me, she was worth every...everything!!Good Luck and applaude goes out to your new hubby! I go by the old saying....anyone can be a father...but it takes a special man to be a daddy!!!YEH!!

i believe that your son's father has to sign away his parental rights for your new husband to be able to adopt your son. i'd talk with the family court for the information you need.

The father actually does need to agree to sever his parental rights before anything can be done.
