I am having major problems with heavy ATV use in my INCORPERATED neighborhood. I am also (high-functioning)autistic and have major sensitivy to loud noise. If you have info on acceptable deciBel level vs. unacceptable for an incorperated township, please tell me. Also, if you could tell me the deciBel level of an ATV, this would be helpful as well. Thank you.

Contact your local law enforcement or the chairperson of your incorporation. They can tell you how best to proceed. Depending on the type of ATV you are looking at 99-106 decibels. Good luck to you.

It depends what state you're in.

In California, Penal Code section 415 (2) prohibits someone from disturbing another person with a loud or unreasonable noise.

Contrary to popular belief there is no time frame during which someone is allowed to be unreasonably loud, all that it takes is for the other person to be disturbed by the noise, whether it be 2 in the morning or 2 in the afternoon.

Having said that, the police cannot be a victim to this type of crime, so you'll have to press charges yourself. Also, warnings prior to charges being pressed are the standard, so don't expect much action the first time you call the police out cause they will give the person a warning. After that, they're fair game

Your specific noise is about ATV's. In my experience, off road vehicles of that type are generally prohibited in Incorporated areas, but that would vary, city to city.

Call the police and be ready to file a complaint and follow up on it. That should take care of the problem.

Many police / sheriff departments now take "complaints" over the telephone and file a report. I don't know that such reports can be filed through e-mail (plus, if it is an electronic file, personal information could be compromised). The easiest and still the best way is to have an officer / deputy come to your residence (or work place) and file a report face to face. Don't be pushed aside with being told that there's really nothing that can be done with a noise violation except the officer / deputy telling the guilty one(s) to quieten the noise. Most towns / cities have noise ordinances and a failure to comply can result in a ticket or even jail.

Go on-line to your local village hall or police station and look for an online form or email address to send a complaint. I sent a complaint to my village hall a month ago about my neighbors garbage problem. The village solved my problem within a week.
