I got a misdemeanor for criminal damage for accidently knocking over a rim, while I was in a tire and rim store. Now I'm having a hard time getting a job. I have worked for some great companies and have an excellent work experience, but this misdemeanor is killing my chances at getting my life back on track.

As others have stated here, you can get your record expunged. However, there are a few facts you should know. Expungement does not delete anything from your record. What it does is update your record to relect that you retroactivly changed your plea to not guilty and judge is setting aside the conviction. It does not delete the conviction. Although you should contact an attorney to confirm everything I am saying, what I am saying in most cases will be correct. What expungement does for you is allow you to fill out the secion on a job application that says have you ever been convicted of anything as a no. It also gives you a legal basis to sue if you are denied a job, unless the job is for some government agency or a few other cases, based upon an expunged conviction.

The laws for expungement are different from state to state and county to county. Check with the self help legal deparment. Most counties have them.

Also in most cases you have to have paid your fine and done your probation, if any before you can be granted an expungement. Also you usually have to wait 1 year after you have resolved all court ordered punishment.

Just like one of the other responders said, you can go to the court and ask to have the record expunged. I don't know what state you're in, but in California it's easy to do. You must have completed your probation. I'm sure you can pay an attorney, but you can find a way to do it cheaper by going pro bono (on your own). You might need to consult a free legal aid service and/or do research on Google.

Personally, I'm surprised that a minor misdemeanor like this would be used against you. The employers you're applying with must be really hard nosed! Good luck.

The absolutely free background check sites generally provide the most basic of information, such as name, age and address. To get further information, money will have to be paid. The free searches do not provide much more than what can be found through the phone book or personal knowledge. It's impossible to get a free background check.

Stay away from shady background check sites, most likely you won't get any information after you make the payment. Not to mention you won't get a report and you won't get an answer if you try to call for a refund. I dont know about your state or if all states are the same but in Georgia where I live after 7 yrs the jobs aren't suppose to look that far back on misdemeanors. You can then go to the courts just as the others have said but it is not cheap but hey neither is life huh? I know been there and done it Good luck

I don't understand how a misdemeanor like this could deter you from getting a job. Not unless your applying for a job selling glass or something else that can easily be broken thru carelessness. I don't think it's even listed on a criminal background check. Are you sure this is the only thing detering you from getting a job?

Expungements are usually granted through the DA's office, but usually only if the case was dropped or you were found not guilty.

If you pled guilty or were found guilty, you will probably not be able to get it taken off of your record.

Depending on where the court is located, in Georgia, for example, you can request an expungement yourself.

Check with the local law enforcement office where you were charged. They should be able to advise whether or not an attorney is required to file the paperwork.

It depends on if it is a Class A, B or C misdemeanor. If you call a criminal attorney and just ask which class misdemeanors can be expunged then you will know if you can get it removed. If it is one that can not be removed then it stays with you for life.
