but it ran out ages ago. He has been living and working in the US ever since. What on earth do we need to do in order to get married? Does he get automatic permanent residence status if we are married? Does he have to leave the country and re-enter? I'm lost and need advice. We are both scared that he won't be able to come back here if he leaves.

Legally, if your boyfriend leaves the United States, then it would be a problem because they won't let him back in for about 3-10 years more or less. Even though your boyfriend didn't enter illegally, he overstayed his VISA, which puts him in an illegal situation. If you were to get married, then yes, he would get automatic residency provided that your marriage is bonifide. If it's possible and you or your boyfriend can afford it, the easiest way to get married is to go fly or drive to Las Vegas and get married there as there's no waiting period or blood tests like in a lot of states. Apparently, you can get married with just a driver's license. I'm also an American and married an European and we got married in Las Vegas in 2002 at the civil office but just before his Visa expired.
Another possibility is to enter the green card lottery which occurs once a year during October and is completly free-the chances of this are slim, especially, depending on the country he's from.

U KNOW WHO WILL GIVE U THE BEST ANSWER??? LAWYER.. I'M SERIOUS.. HE BEEN LIVING HERE IN US ILLEGALLY.. IT'S NOT EZ FOR THEM TO GIVE HIM A PERMENENT RESIDENT IF HE MARRIED TO YOU. IF PROBLEM EXISTS.. HE'S GONNA GET BAN BETWEEN 5 TO 10 YRS.. WHICH COUNTRY DID HE COME FRM???

Check with a immigration lawyer. Marriage may not be enough to keep him in the country given his status.

If you are an american citizen, than it doesnt matter if hes visa expired. As long as your an American Citizen you guyz can still get married. But if your not....than that is a big problem.
