This is a non-sequitar. It is unfortunate that his mother died recently, but that has nothing to do with his eviction. You have every right to a peaceful life, and if he isn't fitting in with that, you can certainly boot him out. Yes, he will pull the 'poor me' face, and say that you are being mean to him when he is at his most vulnerable, but you and I know that's a crock.
Get on with your life. You'll actually be doing him a favour by making him face up to the consequences of his behaviour.

This depends on where you live. In some states it doesn't matter weather or not he is on the lease as long as he has "established residency". Usually this will mean having at least one utility bill at that address, filing taxes from that address, or even just having it on his driver's license. Look into what your rights are under the law in your area, and if you are within your rights to do so have the locks changed.

if he's on the lease and hasn't done anything to violate the terms laid out therein, then an eviction isn't even a possibility. i would just throw all his stuff out the window.

I think that you should follow your heart in this situation. How recent was the death? I think you could give him a month after his mother died (my husband's mother recently died too), give him a little time to find a new place, but put a firm date in his mind.
Hope that helps.

It's time for him to go. And yes, unfortunately, you will have to go through an eviction process.

Start the paperwork; if he is an angry drunk; you're in danger.

well if it is that bad then you should be confident and kick him out because if he cant respect you and your needs then he does not need to be there.
