Well, it depends on how bad you got it and if you can prove it was that restaurant. It's hard to actually prove it ya know? People get food poisoning all the time, but can never prove it was a certain restaurant.

It's hard to sue for food poisoning. You have to prove they poisoned your food, and you have to prove intent. The restaurant may have gotten some items from a supplier and the restaurant relied on the product or products as being good. You have a lot of tracing to do if you want to go this route. Plus, what would you get out of it? I have yet to see someone "get rich" because they had some bad food and got sick.

I had a friend who once ordered a philly cheese steak sandwich at Hooters (high class restuarant). When he took a bite, a friend sitting across the table asked what was with the cheese on his sandwich. It had maggots in it! My buddy spent the next couple of days in the hospital with food poisoning (among other things). The restuarant obviously picked up the bill for the hospital. Could my friend have sued? Sure, but people are too sue happy these days. If the restuarant does what it can to make things right...c'est la vie.

I work for the government in food safety so I can help you out with this one. First, you go to your doctor, who will diagnose your illness. This may involve stool (poop) samples. If anyone else ate at the restaurant with you and is/are also sick, make sure the doctor knows. If there is enough info an investigation will be carried out by state health officials. If its inter-state, CDC may even get involved. If they determine there is a link, then you have a case.

food poisoning is extremely hard to prove. How do you know it wasn't something else you ate that day? (that is what the restaurant will say).Just don't go back and warn your friends.

It is very difficult to prove that you got poisened a particular resturant unless others did too. It can take 12-24 hours for it to happend sometimes as well. Your best bet is to write a very nice letter to the owner explaining what happened. They'll probably send you a gift certificate for a free meal if you dare come back! :)

Yes, but only if it made you sick as a result of their preparation or lack of cooking or if it was spoiled food. If it's cuz you were alergic to it or it just made you sick because of your digestive system, then you don't have a case.

Sure you can sue them for making you fat, why not? After all who would think that eating 5 big macs a day would pack on the fat? They expect us to be able to figure this out by ourselves? Come on.

It's extremely hard to prove, so I recommend calling them first, explaining what happened and seeing what their attitude is like.

If they offer to reimburse you or make you whole some other way, I would recommend not suing.

Only if their attitude sucks would I recommend going further. It's a lot of work and like I said hard to prove.

it would be hard to prove where you got the food poisening, considering that probably wasn't the only meal you had that day (god people are sue happy now a days)
