Attacking is wrong, but gays are largely not accepted in many countries and the law does not normally side them. Police = law enforcer. Thats why.

For any kind of intelligent discussion to go on about your question, it would be helpful for you to provide details. Where did this happen? What evidence do you have that "police do not think that an attack on a gay guy by four black guys is not a hate crime" ? What evidence do you have to conclude that police think one way or other? Were these four men charged? An attack on anyone is a crime regardless of how it is categorized by police or anyone else.

In Canada if the motivation for the the four men assaulting the "gay guy" was solely based on his sexual orientation then the incident could be investigated as a hate crime. If however the motivation of the men "jumping" him was to commit a personal robbery (mugging) then it would would not be investigated as a hate crime.

The police wouldn't charge them with a hate crime, the prosecutor would. With all the crimes police see day after day, they don't consciously sort them out into all their PC categories. Crimes are crimes. The prosecutor makes the hate-crime decision.

Did they jump you because you were gay, or did they just want your money. Their intent, and the ability to prove it, is what is needed to prosecute a hate crime.

Attacking anyone is a crime
Hate Crimes are crimes against thought, It is a more severe crime to attack some one because of what you "think" about them.
It doesn't matter who attacks who it matters what they are thinking when they do it.
If the government does not like what you are thinking they now can make it illegal

The assault is a crime itself but did the black guys know he was gay?
If they did, and the assault was a result of him being gay then it is a hate crime.
If his assault was random then it is just an assault.
