That's extremely annoying and rude.
They new it was an exam and they probably did it on purpose just to see if anyone would do anything. I don't like people like that.
If it were me, I would have taken the pen and switched it with a normal ball point one when they weren't looking. If that didn't work, I would have asked them to stop. If that didn't work, I would have taken the pen and thrown it out the window when they weren't looking, then I would act like nothing happened.

You should have stood up, grabbed the pen and broke it. Then flung it across the room in a fit of incredible range. It would have been awesome.
