However there is a problem, when we went to the bank, they said we need to do his taxes..He's not paid them in sometime, because he went to a trade school and had to get a loan to help him along the way..He's paid the loan off several times, but the tax people would keep his income tax..so he stopped filing....what do we do?! any help here would be apprieated!

I am a mortgage banker and filling out a non-filed 1040 will get you into deep trouble in the area of fraud. At closing you sign a form which is called a 4506 that gives the mortgage holder authorization to pull for filed taxes. So that being said, file the back taxes and keep your copy. I do several VA mortgage loans and have found that being up front with your banker will get you an approval a lot quicker. Your problem is not unusual

File your taxes. Don't do anything illegal, and PROVIDING FALSE TAX RECORDS IS A CRIME. Just file the tax returns. And get professional credit help for resolving unpaid student loans.

This probably isn't a legal way, but since you haven't filed taxes, you aren't exactly legal either
If you know what your income was last year, you can go online IRS.GOV and get a 1040 form and fill it out and give it to them. They won't know that you didn't file them.
