One can ONLY pay child support if an income is earned. Relying on a "degree" (and by the way.......... an AA degree doesn't mean squat), is like squeezing blood from a turnip.

You can get an AA degree from a cereal box. The most you CAN do is provide proof of what he has made in the PAST and use that for child support calculation. This safety was put into place to keep deadbeats - both moms and dads - from quitting good paying jobs to keep from paying child support. Now, if he can PROVE that he can't get a similar job to what you are claiming, then the most you can claim is minimum wage, etc. Any good attorney can help you with this; or go to the local child support office. Good Luck!

I am a step mom and not a lawyer, but I can tell you that in my experience, it doesn't matter if he has a job or not. Before I got married to my husband, he was between jobs. His child support was based on his ability to make an income - basically what he should be capable of earning based on his education, experience, etc and not what he was earning. He was still responsible to pay the support even though he didn't have a job. I think it can vary in each state depending on the guidelines, so talk to a lawyer. But, just because he doesn't have a job, doesn't mean he isn't responsible!

Yeah I agree with the others. You can't do too much with an AA degree and on top of that he has no job. But you can file for child support and they will make him get a job, or he could go to jail.

An AA degree isn't worth anything. So he can work at walmart, instead of McDonalds. So what? Walmart would probably hire him without it anyway..that's as far as an unspecialized degree gets you.

If your ex is not working, then the child support is set at 20% of minimum wage. He still has to pay that even if he's not working, if not he'll go to jail.

go to your local child support enforcement and go after him for child support. when he does get a jod his social security # will pop up and they will find out where he works. If you get a IDO. which is an income deduction order they will automatically take it out of his check....Then if he doesnt pay they will suspend his licesnse or take his taxes (which you will get) drain his bank account or even put him in jail. But he has to work
