The company that set this up has been shut down for about 8 yrs. and I didn't find out about my name being used until years after thur a secondary lender calling and harassing me for payments. The mobile homes being purchased were for relatives, who had been told that they could just use my credit to get in the houses and drop my name after six months which was not done.Now this lender says that my name can't be removed because their credit is bad, (one has been repo'd & the other one still calls me instead of the person who has the house). I've sent letters to the companies and copies of the paperwork that the closed company forged, and still can't get results. Since this started, I've had my own personal finance issues which have caused me to loose a lot after being retired (forced) from my job. Is there a legal inexpensive way to change both of these mobiles homes out of my name and off my credit? Supposively, there was a lot of illegal occurrences before the shutdown.

You have a problem. You need to file a criminal complaint with the appropriate prosecutor. If criminal charges are filed, then you need to dispute your credit report REFERENCING the police report and the criminal case.

If you did not sign anything, including powers of attorney, then all things are fraudulantly in your name. However, the lender will not and probably should not believe this unless you affirmatively take action to work towards prosecution. Unless the current lender wants to bring in handwriting experts and presuming the individuals involved really committed fraud, you will get it off your credit then.

A police report at the minimum and more likely a criminal prosecution is what is required. This will mean that your relatives will likely be put in jail along with the loan company.

You need a lawyer and the State Attorney General Consumer Fraud division but in the meantime you may want to explore filing a chapter 13 or worst case Chapter 7 bankruptcy. This is going to take a long time to get cleared up.

Your parents have to be willing to sell the place to you for the amount of the loans, you need to know that first. If they will, then go and talk with several local lenders to see if you qualify for a loan to cover what is owed. The only issue I can foresee you having is the appraisal. It has to come in at the amount you borrow or more. If not, then talk to your parents about selling the place to you on a contract for deed. So it would be in your best interests to find sales of similar properties within the last 12 months (4 months is better) and have those available to give to the appraiser. Okay, you definitely need to get an attorney to help you locate the individuals involved in this company. Sue them! Also, you can get your name erased from those erroneous documents. If they are found to be forged, then they no longer stand to be legal. Therefore, they will no longer be bound to you. This will help your credit rating a bit.

this other company would have to produce the loan documents with your signature on them to be legal documents
