2 men rob a bank, both of them know they are robbing the bank. After showing off their guns, the security guard on duty at the bank pulls out his handgun and fatally shoots one of the robbers. Someone in this scenario is charged with 1st degree homicide. Who is it and why?

This is a trick question.

1) This depends on the state. Since the state is not specified, we can't say anything about which laws would apply here.

2) We don't know the circumstances of the case. Was the gun pointed at anybody? It's questionable whether a security guard can shoot somebody just because they're robbing the bank, even if they have a gun.

3) It only says that somebody was charged with a crime. But crime does not presume guilt. Just like anybody can be arrested, anybody can be charged with a crime as well.

The second robber is charged with murder because the other
robber is shot and killed while committing a felony of robbing the bank.

2nd robber is charged with murder for participating in a crime where someone was killed. they became co-conspirators at the point where they both knew the other was robbing the bank - person dies during the commision of a felony its a homicide. security guard is obviously acting in self-defense.

The other robber. After robber #1 is shot and killed by security guard, robber #2 shoots and kills guard. Robber #2 is charged w/ 1st degree.

The bank robber that didn't get fatally shot because they were showing their guns which could be construed as a threat. So it was their fault one of them got shot and he was the only one left to blame.

i think that the guard would be charged because even though the robbers waved their guns around the didnt shoot anyone and the guard just shot one so i think the guard got charged with homicide
