I was told by the hr office at work that ulcers were not serious enough to be under fmla. They also said that plantar fasciatis was not covered. Is this true.
I've had people at work receive fmla for being light-headed, ear infections, family issues.

I missed an extra day of work and they tried to fire me. I had the doctor feel out the forms. I was accused of forging the forms.

Synopsis of Law
Covered employers must grant an eligible employee up to a total of 12 workweeks of unpaid leave during any 12-month period for one or more of the following reasons:

for the birth and care of the newborn child of the employee;
for placement with the employee of a son or daughter for adoption or foster care;
to care for an immediate family member (spouse, child, or parent) with a serious health condition; or
to take medical leave when the employee is unable to work because of a serious health condition.

There is something that you can do about it. FMLA only guarantees a certain amount of days/hours that an employee is able to take leave. I do not remember the exact time, but I think that it is 12 weeks in a 12 month period. You will have to look into it. If this employee exceeds that time frame, the employer has every right to terminate her employment. FMLA just guarantees the job/equivalent job is available when they return. You will need to track the time that the employee misses to ensure that you/the employer is within your right to terminate her. Here in California, we have several other programs that tie with FMLA. The Paid Family Leave Act, and CFRA add to the time that they are granted leave. Check into your state programs as well. Good luck with!!

FMLA doesn't specify the disease, it simply says that you can take a medical leave if you are needed by your family. It also doesn't say you must be paid for that leave, just that you have to have the equivalent of your current job available to you when you get back.

fmla is to allow you to heal, care for an ailing child or spouse. The illness has to be serious enough that you are not able to work. If the ulcers are causing you to miss work or not allowing you to work, gather the request forms and talk with your doctor.
