I don't believe that it depends on which state you live in. I know in Tennessee, and way too many other states (Watch Maury) the legal age to date someone ranges from 1 year to 4. So, yes it is most likely legal especially since neither one of you are over the age of 18.

There is nothing wrong or illegal about it hun. Just keep the physical aspect out of it though, as that is commonly known as "statutory rape" and could pretty much guarantee a nice lil' jail term for the older partner when he or she turns 18, and the other partner is still under age.
