It depends on the city and state laws. Most places say you can shoot if you are in danger. However, just because you feel you are in danger doesn't mean the police are going to agree.

Some have a retreat law. You must TRY and get somewhere away from the person unless that person has a gun. However, you cannot shoot that person in the back even if they have a gun.

It also depends on the size of the person. If say you are a 6 ft man and the person breaking in is a 5 ft woman, you cannot justify shooting her because you are not necessarily in danger.(unless she has a gun)
However if it is reversed,a woman could be justified just because of the size of the man. She could not defend herself.

Other states say you can shoot that person as soon as they enter your house. Some places in Texas you can shoot someone just for being on your property. They do not even have to enter your house.

Call your local sheriff's department and ask them what the laws are for your area. There are just so many if's and gray area's. It is better to know for sure.

Depends on your state laws. A good chunk of the states have come up with a castle law which means a bad guy breaks in you shoot him your automatically innocent, and the bad guy is out of luck. Then some states have a stand your ground law. This law is so that you don't have to flee a bad guy.

that depends on where you live, some areas require you to show that you are in mortal danger, and had no other way of avoiding the danger. so if you are a 6' 5" man you will have a hard time doing that.
contact your local law enforcement to find out exactly the laws are.

If he shows the intent of death or great bodily harm to you (including rape). This would include pointing a gun at you or approaching you with a knife or other such weapon. Other than that you cannot shoot him. You must prove beyond a shadow of a doubt that these criteria are met in order to use deadly force.

Laws are diferent in each state. Most states say you can use deadly force to protect life or property. Where I live in NY I could only use deadly force after they killed me, And then the gun better be registered or My Sole can spend a year in jail.

DEPENDS ON THE STATE.
