if his name is on the birth certificate, yes, if not no. the names father has the paternal rights, he can request a paternity test, and he will have to pay for it, if hes not, in order to get rights, but if he is on the birth certificate then yes, no one can just claim a child if they are not named on the birth record.

And why are you referring him to your boyfriend.
It's simple he's avoiding child support.
If the child was conceived out of marriage and he didn't not sign the affidavit of paternity on the birth certificate.
Then in the eyes of the law no.
But if you are trying to seek child support and he refuses to do a paternity test. The Judge can do a default by judgment. The Judge may rule this way if the alleged father has acted in such a matter.

u need to get custody.fast.if he chooses not to do paternity,when and if it ever comes down to child support,he declares himself the father and therefore will have to pay.the only way he wouldn't pay was to take the paternity test,which he pays for(costs $400 which includes Dr.'s signature so it will hold up in court)and it was 2 turn out he wasn't the father.wo custody u r both equal partners,if he was 2 come in and take the baby the police wouldn't help u out 1 bit.u r both the baby's parents.be careful!!!

Sounds like he might be trying to avoid paying child support. Go to your local courthouse and file papers. If he is the father, you will need to prove this through a paternity test. Then, you will be able to get child support.
If he refuses to pay, even after paternity is proved, the court will garnish his wages, assuming he is working. Good Luck.
In the meantime, depending on your situation, you can apply for WIC if you need assistance in caring for your baby.

Go to the phonebook and look for legal aid (they are lawyers that work pro bono for individuals who cannot otherwise afford them). I am almost sure that you can get a court order requesting a paternity test so that your child's legal rights (like child support) are being honored. Also once you do this then the court will be involved with establishing visitation, medical insurance, and next of kin for your child.

I don't know what state your in but in Indiana even if he has signed the paternity affidavid if you two are not married then you have full custody of the child. Hope this helps

Well, if you two are married yes, otherwise you cannot make him accept the child just because he is your boyfriend and because the child you have is his child! By law you cannot do anything to make him do that, but if he has feelings toward you and the child he has to do that!

depends on the state and if his name is on the birthcertificate. in tx if he is on the bc then he has to have not contact for 5 yrs then no rights. if he does well then ya
