theres a good chance that if he appeals for custody and she is shown to be an incomptent care giver, that the state will give him custody. He needs to make his intentions to take care of his baby ASAP and get a lawyer.

It depends on the laws of the state but the best bet would be to contact social services and let them know that you are the father. If you were not married paternity tests can be performed to see if you are the father. You can petition the court to have a home study performed to show that you have a stable place to take care of the child, the means with which to take care of the child, and family support helps. Fathers do have rights but the social services are responsible to make sure that the children receive the best possible care. They will also work with the mother to see if services can be put in place to keep the family together. This doesn't always work but you need to step up so that they know that the child has someone to take care of it. The social service agency works to try and keep the family together and if their is a lack of cooperation sometimes it can lead to them terminating parental rights. As long as the father is showing that he is very serious about raising this baby and has family support they should work with him. Good luck!

The father would likely get temporary custody of the child, because they will not want to have the child in the custody of the person dealing with the drugs. And that person will probley get charged and put in jail for awhile with social services being involved.

You need to contact the children's services and he needs to demand having the child with him!

You need to contact a family lawyer and ask - or you could probably call child services and ask them how he would go about getting custody.

why dont you try to get custody? you would have to wait for them to get the court order to remove the child, then you could file for custody but the key is first waiting on them to remove the child
