your boss about it? who's fault is it, the loaders or the driver?

The driver is always responsible for thier load, so it would be thier fault. In most cases no they will not tell.

Driver's fault....always. You could try not telling, but your empty truck will pretty much give you away once you get to your destination (I'm pretty sure you ain't gonna lift them back up yourself).
