this lock smith i called came to unlock my trunk when he arrived he said he could not do anything i said ok and continued to the house he turned around and stuck a screw driver into the lock and broke it when i seen him he said he would return to fix the lock he never did and now refuses to answer his business phone and his cell phone what type of lawyer do i need and can i sue him?

call any lawyer in the phone book. Most could handle the job. Yes, you have a right to sue. You might want to check into the process of "small claims court". I don't believe you'll need a lawyer then -- it's a more relaxed court (you just tell your side of the story to the judge).

Well first, get 3 estimates on what it will cost to repair the trunk. Was anyone else with you when he stuck the screw driver in the trunk. If you used a cell phone to contact him, keep those bills with his phone numbers on them. Take pics of the trunk, if you haven't already. Send him a certified/return receipt letter demanding that he either repair the damage or pay you for the repairs. Check with your County Clerk to find out what is the maximum amount you can take a person to small claims court. If your estimates are below what the maximum is, you can take the guy to small claims court without a lawyer.

I know it sounds like a lot of work, but those are just some of the things that you will want to gather as evidence against the locksmith. I watch People's Court in the morning before I go to work. The more evidence you have, the better it is for your case.

This is a criminal act... call the police... and report him for breaking and entering your car. Especially when you were not present and he refused to do so in your presence.... then start a Civil suit in Small Claims Court... most times you can do this by yourself... but you need evidence... photos of before and after the fact... or a witness of the event... or a tape showing the event... it would cost you more to pay a lawyer and sue him than it would to fix the lock.. you can file a claim in small claims court..in you state would be cheaper,
