It would depend on the maturity of the child, as well as local laws. A mature 12-year-old might be safer than an immature 16-year old.
Call your local child protective service agency, or the police department and ask anonymously.

Depends on your local government but most dont have an actual "legal age". I would say 12 or 13 myself.
