i m driving from main street ,turning right to fronted to my working place parking lot.i saw 2 car was parking there already. and i din't see d car's light is on so is meant the car is parked.Then i pass by suddenly the car back off,i hav no time to give a warn then he hit my left back door and bumper.the first time he get ogg from the car he din't ask me if i m ok or not.He yelling at me ask me what i'm u doing!And why i din't stop!BUt i already get there how can i stop the car,if i stop he he will hit my front door and i may get injured.and i told him that i can't claimed my insurance company cuz my insurance was ald high.then he ask to get d estimate ,but when i showed him d estimate he said he pay for that tell me to claim d ins.then i make a deal with him ,how about 50/50,but he said wait 2 more day to let him think about it.but i cant wait that long time,cuz is aly past 2 days.when i said want to make a report but he wont let me to.he said is at privete property,police don count

It is not your fault.
(a) Never admit fault at an accident; let others decide -- in court if necessary.
(b) Always call police -- you really do not know what effects may develop as a result and at a later date, so you need a report filed.
(c) you do not need anyone's consent -- do not wait, report this immediately and refuse to discuss the matter -- leave it for the insurance companies. You were nice and it was taken as a sign of weakness -- do not be bullied any more.

Do you have his name, address and license plate? call the police and tell them the story. He is at fault. You should never had made that deal. You should have called the police and filed a report. The insurance company cannot raise the insurance if you can prove that it was not your fault. As long as the police accident report says the other driver is at fault, you should be OK. In the mean time, what if you told the police it was a hit and run just a short while ago and you got the license plate number???

The person driving on the through street/lane has the right of way. The person backing out of the space is supposed to yield (wait) until it's completely clear before backing into the traffic lane.

It sounds fishy to me -- I think he knows he's at fault or he wouldn't be giving you all these excuses not to report the accident.

You could call your insurance agent, explain what happened, and ask for advice. They should be willing to talk to you about it without actually putting in the claim.

Doesn't matter if it is private property, police can still be called. They may not help you since you didn't call them immediately and nobody was injured. They can ticket a driver in a public parking lot, but since it's just a little fender bender odds are they won't bother.

I would just file with his insurance company. That's better than him taking days and days to "think about things"

He should have been looking before he backed up and you should not be driving unless you have insurance

my opinion - if he was parked, it was his fault. he wasn't in motion, which gave you the right to pass behind him. it seems to me that he just put it in reverse and slammed on the gas without looking. so yeah, i think he was at fault.
