I adopted a dog from a shelter that specializes in dogs with special needs. The dog I adopted was supposed to be perfectly normal and housebroken, neither of which was true. I never ended up signing the adopting papers, but I did write a $90 check for her. Then I returned her because things just weren't working out since she was very obviously abused and not housebroken. When I returned her, they still haden't cashed my check, so I figured they just wouldn't, but they did! When I called them about it the first time, they told me that in the papers I signed the return policy said that there were no refunds. I told them I had never signed papers. The second time I called, they told me they weren't "interested inrefunding" my money! When I told her she was legally responsible to produce the papers she says I signed or refund my money, she hung up on me! What should I do to get my money back and/or get the word out? I live in Pa, what are my legal options? Thanks for your help!

Frankly, the best thing would be to call or write your local newspaper or TV stations, especially if they have a consumer help person. You need to get the word out about this place, which should not be foisting damaged dogs on unsuspecting people.

Court would probably take more time than it is worth, even if you are awarded court costs. You might want to contact the Better Business Bureau and see if they can help. Also, down here the TV stations are always looking for this type of story so they can prove that they are "on your side." One of your stations might be interested. Finally, most shelters receive some sort of government aid and/or are non-profit. See if there is a regulating or certifying agency that might be able to help.

If you want to try small claims court, that is about your only option. I think you are going to have to eat this one, though. It is going to take a whole lot more than $90 of your time to go through the process. The filing fee for small claims court is probably $90 and you could lose.

take the fool to court....get a good lawyer and you could maybe end up getting more then just $90 off the case!
