I give a 30 day notice to quit the property first. You have 30 days to pay the rent or vacate. If I have the feeling that you will do a midnight express, I file the eviction paperwork at the same time. Then the court sets a date usually 30 days later, unless they are backed up. Then we go to court, if you don't show I win by default. Marshalls come and post notice to the door of the rental advising that the occupants have been evicted and have 10 days to vacate the premisis. At that time, I file a judgement against you for the unpaid rent and a garnishment of your wages in the amount you owe. After 10 days, I show up with a locksmith and 2 marshalls, change the locks and have the marshalls inspect the unit. I take possession of the unit and anything in it.

Thus, you have about 40 days from the time you are served notice.

Most likely depends on the reason for eviction. If you are trashing the place, not paying your rent and costing the OWNER money, I'd have you out in thirty minutes.

Consider yourself fortunate you are being served a notice and be on your way. If you don't like these circumstances, consider being a better tenant next time.

In most states 30 days. After that your belongings go to the apartment owner and they can discard them however they please.
