Just a thought that came from The Incredibles.

You might. But you would have a hard time recovering because...

(1) Most superheroes have secret identities. In the American legal system, you can file a legal action against a "John Doe" defendant, but can only actually recover from a named party.
(2) Many superheroes are flat broke. They can't make much money because they have employment issues related to diminished performance due to lost sleep while fighting crime, excessive absenteeism due to daytime evil-combating, and behavioral quirks from the effects of superheroic stress. Obviously, the exceptions to this poverty rule, like Batman, are fantastically wealthy and may be a big cache of funds for the successful litigant in a "wrongful heroics" lawsuit. (On the other hand, Bruce Wayne can afford a serious kick-*** defense lawyer).
(3) In the legal system of the United States, superheroes would probably be protected from litigation by the "Good Samaritan" exception, which says one cannot sue persons who make good-faith efforts to save your life for damages sustained by you due to their efforts. While principally designed to protect paramedics and lifeguards, etc., this would probably apply to superheroes.
(4) You have no general legal right in any state except Oregon to relinquish your life. You may do this under certain circumstances related to legitimate refusals of life-sustaining medical treatment in the US, but after the Schiavo Affair, we have no guarantee that Right-to-Life extremists in Congress won't prevent courts from giving you anything for wrongful salvation by a superhero.

So I wouldn't bet your financial future on a non-consensual superhero rescue legal action.

Well, if he was a wealthy superhero, and I could make a whole lot of money, and get a whole lot of publicity and fame ....
No. Then I would be as scuzzy as the villain from The Incredibles, which was pretty scuzzy indeed, though he did have some really neat toys.

It might be hard to sue a superhero since they probably have super lawyers.

Well, I dont think I would sue! I might take out my own revenge on that super hero!

I think your question is FUNNY! No,I wouldn't sue! In fact we as awhole human race have a super hero....Jesus! he sacrificed his life...to save ours...who ever calls upon his name will have eternal life... Not everyone realizes that they need him!
