In all states except 4. 18 is the legal age for smoking. In Alabama, Alaska, Utah it is 19 and in Pennsylvania it is 21. California is trying to make it 21.
FDA and Tobacco Regulation
On March 21, 2000, the U.S. Supreme Court ruled that the U.S. Food and Drug Administration lacks the authority to regulate tobacco. Therefore, FDA no longer maintains its Children and Tobacco Website.
It is not federally illegal for those under 18 years old to purchase or possess tobacco...only for stores to sell to them. Some individual states have enacted legislation making possession by minors against the law.
