The easiest way is to use the crop tool to crop it off then create new text (this time save a psd unflattened version also).

However, you can use the clone stamp tool though this process involves recreating the missing background over the text. Select the Stamp tool. Alt+Left Click an area of the image close to the text that when placed over the text still looks natural. Then slowly fill it in. You may have to repeatedly Alt+Click to resample a new area of the image to keep from getting a horrible repeating pattern.

The above is good advice. The only thing I'd add is choose a brush (not pencil) size for the clone stamp that is appropriate for the area. A brush will give you better blends (reduce the opacity to 50% - more clicks but more control). You also may need to change brush sizes while you work. The [ and ] keys are quick ways to manipulate the size of the tool.

A real lazy trick is to select the text letters individually, then fill with a color close to the background. Makes cloning quicker.

That depends on the text. If you are trying to remove the text that a photographer or studio put on the picture...it's illegal. They own the copyright to that picture unless you receive a release from them.

If it's not the text from a studio or photographer than either choose the clone stamp or crop the picture as was stated in previous sources.

I'm guessing they are in jpeg format, which means the image is flat (no layers). You can use the clone stamp or the healing tool (it looks like a bandaid) Press the Alt key down and click on the area you want to put over the text....and you're all set.
