Sports betting is illegal due to the 1961 wire act. There have been successful prosecutions of USA citizens that operate sports books on the internet. To date, no bettors have ever been charged.

Online casinos and poker rooms are completely different. While the Department of Justice will say that they are illegal, they have never charged an online casino or poker room operator with any crime, most likely because they would lose in court and set a precedent they would not like to see. Likewise, no casino or poker room players have ever been charged with any crime.

Numerous attempts have been made to pass laws regarding internet gambling, however nothing has been signed into law at the federal level.

One state has banned internet gambling and put in stiff penalties. Washington state has recently made it a class c felony to gamble over the internet with a 5 year maximum sentence and a $10,000 fine, however regulators have said that they have no intent to use the law against bettors, but rather gambling site operators that are from their state.

It depends on the State. Washington State just passed a law making it illegal and I think most states are doing the same.

There are plenty of sites where you can play poker either with or with out Money. Pokerstars.net is with out money... Bodog.com you can practice (play with no money) or play (with real money). It's leagal... but well better becareful.. I bet it's much easier to get in over your head when you don't actually have to walk away from the table and to the ATM to get more money.
